Access to and use of the website (the “Website”) for the Philanthropy for Better Cities Forum (the “Forum”), the mobile application for the Forum (the “APP”) and/or registration system provided via the Website and/or the APP (the “System”) are provided by The Hong Kong Jockey Club (the “Club”) subject to the following terms:

Your use of the Website, the APP and/or System signifies your agreement to be bound by these Terms of Use and all applicable laws without limitation or qualification. If you do not agree to the aforesaid terms and conditions, please stop using or accessing the Website /the APP / the System.

Use of Information and Materials in the Website and/or the APP

Unless otherwise stated, all information and materials in the Website, the APP and the System are for information purposes only and are not legally binding. Information and materials in the Website, the APP and the System are provided "as is" and "as available" without warranty of any kind, either express or implied. In particular, no warranty regarding non-infringement, security, accuracy, timeliness, fitness for a purpose or freedom from computer viruses or otherwise is given in connection with such information and materials.
You acknowledge and agree that in using the Website, the APP and/or the System, including but not limited to using any service as a registered user, your telecommunications service provider may charge certain fees based on the volume of data transmitted and/or charge any other fee as may be agreed between you and your telecommunications service provider.
A link or reference to any third party company, service, product, mobile application or website in the Website, the APP and/or the System (the “Third Party Services”) does not in any way amount to or imply endorsement by the Club, or any host or sponsor of the Forum, including but not limited to The Hong Kong Jockey Club Charities Trust (the “Trust”). The Club makes no express or implied warranties or representations with respect to the accuracy, timeliness or completeness of any information contained within such Third Party Services.
Your use of the Third Party Services shall be at your own risk. In no event shall the Club have any liability of any kind to any person or entity arising from or related to any use of Third Party Services.
Your access and use of the System and registration of the Account shall be subject to the Terms of Conditions for using the System.

Inbox Messaging and Networking Function

The APP offers inbox messaging and networking function, where you may interact with other attendees and send messages to others in text form (“User Submissions”).
By default, your Account will be set as ‘private’ and all messaging and networking functions are disabled. If you would like to interact with other attendees via the APP, you may turn off the ‘private’ mode. By turning off the ‘private’ mode, you consent that your name, company name, job title and profile picture (if any is uploaded by you) and LinkedIn (if any is connected by you) will be shown on the contact list and be visible to other attendees who has also turned off the ‘private’ mode. You can start searching and interacting with other attendees accordingly. You may turn on or off the ‘private’ mode and disable the messaging function at any time.
You shall use the inbox messaging and networking function responsibly. Violations would include activities like: i) creating network issues or clogging network traffic to hamper other attendees, ii) sharing any content that may be inappropriate (e.g., pornographic material, content encouraging vandalism, crime, terrorism, racism, violence, or cruelty), iii) engaging in abusive online behaviour, iv) trying to send “spam” emails/notifications/messages in bulk, or v) trying to elicit passwords/other confidential information through misrepresentation, and other such actions. Violation will lead to instant deletion of Account.
The Club or the Trust is not responsible for the accuracy, timeliness, completeness, use, or misuse of any User Submission or the User Submission that you disclose or receive through inbox messaging and networking. Your use of the inbox messaging and networking function is at your own risk.

Privacy

By accessing, registering and/or using the Website, the APP and/or the System, you are deemed to have read, and fully understand and agree with the contents of the Privacy Policy Statement of the Club and the Trust.

Indemnity

You agree to on demand defend, indemnify and hold us and the Club and its affiliates (including but not limited to the Trust) harmless from and against all liabilities, damages, claims, actions, costs and expenses (including without limitation legal fees), in connection with or arising from your breach of any provision in these Terms of Use, your use of the Website, the APP and/or the System for any purpose whatsoever (whether or not constituting a breach of any provision in these Terms of Use ). We may, if necessary, participate in the defense of any claim or action and any negotiations for settlement. No settlement which may adversely affect our rights or obligations shall be made without our prior written approval. We reserve the right, at our own expense and on notice to you, to assume exclusive defense and control of any claim or action.

The presentation and all contents of the Website, the APP and/or the System, including but not limited to names, likenesses, images, illustrations, audio clips, video clips, logos, symbols, marks, products and services, are subject to copyright, design rights, trademark and other intellectual property rights of the Club, the Trust and/or other third parties. Unauthorized use of these materials is strictly prohibited.

Limitation of Liability

The Club specifically disclaim any liability for any direct, indirect, incidental, consequential or special damages arising out of or in any way connected with your access to or use of the Website, the APP and/or the System, including but not limited to any loss or damage caused by malware affecting your computer equipment or your reliance on information obtained through the Website, the APP and/or the System. By accessing the Website, the APP and/or the System, you agree to hold the Club harmless against any claims for damages arising from any decisions that you make based on the information on the Website, the APP and/or the System.

Third Party Rights

You and the Club agree and acknowledge that (1) they do not intend any term of these Terms of Use to be enforceable by any third party pursuant to the Contracts (Rights of Third Parties) Ordinance (Cap 623); and (2) these Terms of Use shall be excluded from the application of the Contracts (Rights of Third Parties) Ordinance.

Update and Interpretation of Terms of Use

The Club reserves the right to update these Terms of Use at any time without prior notice to you.
In the event of dispute, the decision of the Club shall be final, conclusive and binding.
These Terms of Use are written in English and the Chinese version is translation for reference only. In the event of inconsistency between the English and Chinese versions, the English shall prevail.

Governing Law and Jurisdiction

These Terms of Use shall be governed by the law of the Hong Kong Special Administrative Region. You agree to submit to the non-exclusive jurisdiction of the Hong Kong courts.
